The judges ruled that the appointments he made to the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">National Labor Relations Board<\/a> are illegal, and hence the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">five-person board<\/a> did not have a quorum to operate.<\/p>\n<p>But the ruling has even broader constitutional significance, with the judges arguing that the president\u2019s recess appointment powers don\u2019t apply to \u201cintra-session\u201d appointments \u2014 those made when <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> has left town for a few days or weeks. They said <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a> erred when he said he could claim the power to determine when he could make appointments.<\/p>\n<p>\u201cAllowing the president to define the scope of his own appointments power would eviscerate the Constitution\u2019s separation of powers,\u201d the judges said in their opinion.<\/p>\n<p>The judges said presidents\u2019 recess powers only apply after <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> has adjourned a session permanently, which in modern times usually means only at the end of a year. If the ruling withstands <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\">Supreme Court<\/a> scrutiny, it would dramatically constrain presidents in the future.<\/p>\n<p>And the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\">court<\/a> ruled that the only vacancies that the president can use his powers on are ones that arise when the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> is in one of those end-of-session breaks. That would all but eliminate the list of positions the president could fill with his recess powers.<\/p>\n<p><strong><a href=\"http:\/\/www.washingtontimes.com\/topics\/white-house\/\">White House<\/a> dissent<\/strong><\/p>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_22906\" aria-describedby=\"caption-attachment-22906\" style=\"width: 233px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Propaganda-Minister-Jay-Carney.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-22906\" src=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Propaganda-Minister-Jay-Carney.jpg\" alt=\"\" width=\"233\" height=\"300\" \/><\/a><figcaption id=\"caption-attachment-22906\" class=\"wp-caption-text\">Propaganda Minister Jay Carney<\/figcaption><\/figure>\n<p><a href=\"http:\/\/www.washingtontimes.com\/topics\/white-house\/\">White House<\/a> press secretary <a href=\"http:\/\/www.washingtontimes.com\/topics\/jay-carney\/\">Jay Carney<\/a> called the ruling \u201cnovel and unprecedented,\u201d and said it contradicts 150 years of practice by presidents of both parties.<\/p>\n<p>\u201cWe respectfully but strongly disagree with the rulings,\u201d he said.<\/p>\n<p>But <a href=\"http:\/\/www.washingtontimes.com\/topics\/noel-francisco\/\">Noel Francisco<\/a>, a lawyer at Jones Day who argued the case for the <a href=\"http:\/\/www.washingtontimes.com\/topics\/us-chamber-of-commerce\/\">U.S. Chamber of Commerce<\/a> and the company that challenged the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">NLRB<\/a> appointments, said the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\">court<\/a> had returned to the Constitution\u2019s intent, which was to make the recess appointment an emergency power for use only when <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> was not available.<\/p>\n<p>\u201cIssues like this \u2014 it\u2019s not about protecting the <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> from the president and the president from <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a>,\u201d <a href=\"http:\/\/www.washingtontimes.com\/topics\/noel-francisco\/\">Mr. Francisco<\/a> said. \u201cThe Constitution draws these lines ultimately to limit the government to protect the people.\u201d<\/p>\n<p>In their ruling the judges said their duty is not to speed up the workings of government, but to hold to constitutional principles.<\/p>\n<p>\u201cIf some administrative inefficiency results from our construction of the original meaning of the Constitution, that does not empower us to change what the Constitution commands,\u201d the judges wrote.<\/p>\n<p>The judges said the recess power was created for a time when <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> met only a few months out of the year, and was designed for the president to fill vacancies during the long periods when <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> was not meeting. In modern times, when <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> is almost always capable of meeting, the recess powers should be more circumscribed.<\/p>\n<p>In the short term, the ruling invalidates one <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">NLRB<\/a> decision. But over the longer term it could invalidate a year\u2019s worth of decisions by the independent agency, could undercut <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a>\u2019s new consumer watchdog agency set up in the 2010 Wall Street reform law, and could even call into question decisions made by some judges who were given recess appointments.<\/p>\n<p><strong>Defining recess<\/strong><\/p>\n<p>The case is likely to end up before the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\">Supreme Court<\/a>, and will likely on the definition of what the Constitution means when it says \u201crecess.\u201d<\/p>\n<p>Last January <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a> named union lawyer Richard Griffin and Labor Department official Sharon Block, both Democrats, and a Republican, <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">NLRB<\/a> lawyer Terence Flynn, to the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">labor board<\/a> using his recess powers. He also named Richard Cordray to head the new Consumer Financial Protection Bureau, using those same powers.<\/p>\n<p>Noel Canning, a bottling company, sued the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">NLRB<\/a>, arguing that a rule issued by the <a href=\"http:\/\/www.washingtontimes.com\/topics\/national-labor-relations-board\/\">new board<\/a> was illegal since the recess appointments were unconstitutional. <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> Republicans, led by Minority Leader <a href=\"http:\/\/www.washingtontimes.com\/topics\/mitch-mcconnell\/\">Mitch McConnell<\/a>, joined in the suit.<\/p>\n<p>The appeals court panel, which sits in Washington, D.C., was skeptical of <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a>\u2019s case during oral argument in early December, with Chief Judge David B. Sentelle and Judge Thomas B. Griffith peppering the administration lawyers with questions.<\/p>\n<p>The Constitution gives the president the power to nominate judges and executive branch officials, but the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> must vote to confirm them before they take office. Article II, Section 2 of the Constitution grants the president powers \u201cto fill up all vacancies that may happen during the recess of the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a>.\u201d<\/p>\n<p>Those powers have produced centuries of give-and-take, with senators regularly slow-walking nominees and the <a href=\"http:\/\/www.washingtontimes.com\/topics\/white-house\/\">White House<\/a> looking for ways to get its nominees in place \u2014 including the recess appointment.<\/p>\n<p><a href=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Obama-Shred-Constitution.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-22901\" src=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Obama-Shred-Constitution.jpg\" alt=\"\" width=\"620\" height=\"496\" \/><\/a><a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a>, though, appeared to break new ground by acting at a time when the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> was meeting every third day, specifically to deny him the chance to make appointments.<\/p>\n<p>The problem is the word \u201crecess\u201d has several meanings in legislative-speak. It can mean a short break during the day, it can mean a break of days or weeks for a holiday, or it can mean the end of a yearly session.<\/p>\n<figure id=\"attachment_22905\" aria-describedby=\"caption-attachment-22905\" style=\"width: 384px\" class=\"wp-caption alignright\"><a href=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Senate_in_session.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-22905 \" src=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Senate_in_session.jpg\" alt=\"\" width=\"384\" height=\"256\" \/><\/a><figcaption id=\"caption-attachment-22905\" class=\"wp-caption-text\">U. S. Senate<\/figcaption><\/figure>\n<p>The president argued that even though the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> was convening every three days, the pro forma sessions didn\u2019t allow any business, and nearly every senator was absent from the chamber, signaling that the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> wasn\u2019t able to perform its confirmation duties and should be considered essentially in recess.<\/p>\n<p>His opponents had warned that if <a href=\"http:\/\/www.washingtontimes.com\/topics\/barack-obama\/\">Mr. Obama<\/a>\u2019s stance prevailed, then presidents could make appointments when the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> takes its midday recess for weekly party caucus lunches.<\/p>\n<p>The judges on Friday ruled that the only clear bright line is when the <a href=\"http:\/\/www.washingtontimes.com\/topics\/senate\/\">Senate<\/a> recesses at the end of the year.<\/p>\n<p>\u201cThe dearth of intra-session appointments in the years and decades following the ratification of the Constitution speaks far more impressively than the history of recent presidential exercise of a supposed power to make such appointments,\u201d the judges wrote. \u201cRecent presidents are doing no more than interpreting the Constitution. While we recognize that all branches of government must of necessity exercise their understanding of the Constitution in order to perform their duties faithfully thereto, ultimately it is our role to discern the authoritative meaning of the supreme law.\u201d<\/p>\n<p><a href=\"http:\/\/www.washingtontimes.com\/topics\/victor-k-williams\/\">Victor K. Williams<\/a>, an assistant professor at Catholic University School of Law who filed briefs arguing that the <a href=\"http:\/\/www.washingtontimes.com\/topics\/supreme-court\/\">court<\/a> should reject the case as a political question between <a href=\"http:\/\/www.washingtontimes.com\/topics\/congress\/\">Congress<\/a> and the president, called the judges\u2019 ruling \u201chistorically wrong.\u201d<\/p>\n<figure id=\"attachment_22909\" aria-describedby=\"caption-attachment-22909\" style=\"width: 242px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Mitch_McConnell_official_photo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-22909 \" src=\"https:\/\/wp-media.beliefnet.com\/sites\/244\/2013\/01\/Mitch_McConnell_official_photo.jpg\" alt=\"\" width=\"242\" height=\"307\" \/><\/a><figcaption id=\"caption-attachment-22909\" class=\"wp-caption-text\">Minority Leader Republican Mitch McConnell<\/figcaption><\/figure>\n<p>\u201cThis panel of the D.C. circuit has accomplished what Minority Leader <a href=\"http:\/\/www.washingtontimes.com\/topics\/mitch-mcconnell\/\">Mitch McConnell<\/a> failed to do. This D.C. circuit panel has been successful where <a href=\"http:\/\/www.washingtontimes.com\/topics\/mitch-mcconnell\/\">McConnell<\/a> failed. they have really, effectively challenges the president\u2019s ability to govern,\u201d <a href=\"http:\/\/www.washingtontimes.com\/topics\/victor-k-williams\/\">Mr. Williams<\/a> said.<\/p>\n<p>The judges\u2019 ruling puts them at odds with several other federal appeals courts that have ruled the other way.
