In<br \/>\n<a href=\"http:\/\/www.courts.state.va.us\/opinions\/opnscvwp\/1090682.pdf\">ruling<\/a><br \/>\nagainst them today, the Virginia Supreme Court held that while a<br \/>\ndivision in a diocese can be ugly and contentious, only if you<br \/>\nconstitute a bona fide division of TEC are you entitled to hold on to<br \/>\nyour buildings. And you can&#8217;t be a division of TEC if you belong to the<br \/>\nChurch of Nigeria. Q.E.D. <\/p>\n<p>So it&#8217;s back to court the parties go.<br \/>\nOver at the <a href=\"http:\/\/www.episcopalcafe.com\/lead\/dioceses\/virginia_supreme_court_rules_i.html#comment-23654\">Episcopal<br \/>\nCafe<\/a>, Jim Naughton&#8217;s immediate take is that this bodes very well<br \/>\nfor the Virginia diocese and TEC. That&#8217;s because when it comes to<br \/>\ndeciding on the merits a property dispute involving a hierarchical<br \/>\nchurch, Virginia case law is all on the side of the hierarchy. I presume<br \/>\nthat in CANA-land, there is much gnashing of teeth and regret that they<br \/>\ndidn&#8217;t just create themselves as an association of dissident<br \/>\ncongregations within the diocese. Woulda, coulda, shoulda. He is co-editor of Religion by Region, an eight-volume series on religion and public life in the United States, and co-author of The American Establishment, Making Capitalism Work, and One Nation Divisible: How Regional Religious Differences Shape American Politics.
