Forty-one states have either laws or constitutional amendments prohibiting same-sex marriage.<\/p>\n<p>The decision &#8220;threatens to reignite the contentious debate in Congress over gays and lesbians in the military,&#8221; notes Charles Hoskinson in <em><a href=\"http:\/\/www.politico.com\/news\/stories\/0911\/64852.html#ixzz1ZTny3gWK\" target=\"_blank\">Politico.<\/a>\u00a0<\/em>Federal law does not recognize same-sex marriages.<\/p>\n<p>In fact, a number of Congressmen vowed to overturn the Pentagon ruling.<\/p>\n<p>The memo notes that \u201ca chaplain is not required to participate or officiate in a private ceremony if doing so would be in variance with the tenets of his or her religious or personal beliefs,\u201d writes staff writer Andrew Tilghman for the\u00a0<em><a href=\"http:\/\/www.armytimes.com\/news\/2011\/09\/military-chaplains-same-sex-weddings-093011w\/\" target=\"_blank\">Army Times,<\/a> <\/em>a civilian-owned newspaper. &#8220;In addition, a chaplain\u2019s participation \u201cdoes not constitute an endorsement of the ceremony\u201d by the Defense Department.<\/p>\n<p>In a separate memo also released Friday, Pentagon lawyer Jeh Johnson directed base commanders to make decisions about the use of Defense Department \u201creal property and facilities, private functions for religious and other ceremonies &#8230; made on a sexual-orientation-neutral basis, provided such use is not prohibited by applicable state and local laws.\u201d<\/p>\n<p>The move was hailed by homosexual advocacy groups and denounced by conservative groups such as the Concerned Women for America.<\/p>\n<p>\u201cThe Pentagon has clearly overstepped its bounds,\u201d said Penny Nance, chief executive officer for the Virginia-based group.\u00a0\u201cAs part of the federal government, the Department of Defense must abide by federal law including the Defense of Marriage Act, which permits marriage only between one man and one woman.\u201d<\/p>\n<p>Congressional\u00a0lawmakers who opposed the repeal of \u201cdon\u2019t ask, don\u2019t tell\u201d forced the Navy to reverse itself in April when Navy officials recommended allowing chaplains to perform same-sex marriages. On Friday, lawmakers called the Pentagon\u2019s decision illegal and vowed to block it.<\/p>\n<p>\u201cThe Department of Defense has decided to put the White House\u2019s liberal agenda ahead of following the law,\u201d said Rep. Todd Akin (R-Mo.). \u201cThe Defense of Marriage Act makes it clear that for the purposes of the federal government, marriage is defined as between one man and one woman. The use of federal property or federal employees to perform gay marriage ceremonies is a clear contravention of the law.\u201d<\/p>\n<p>The constitutionality of the 1996 law is in doubt after several court rulings against it, and the Obama administration announced in February that it would no longer defend DOMA against challenges.
