Gateway Church in Southlake, Texas, and three of its elders have been dismissed from a defamation lawsuit filed by Cindy Clemishire, the woman former pastor Robert Morris admitted to sexually abusing when she was 12 years old.<\/p>\n

The Dallas-based Fifth Court of Appeals ruled that allowing the claims against Gateway Church and elders John D. “Tra” Willbanks, Kenneth W. Fambro II and Dane Minor to proceed would violate the First Amendment’s ecclesiastical abstention doctrine, which generally prevents civil courts from intervening in matters involving church doctrine or governance.<\/p>\n

The appellate court reversed an earlier decision by Dallas County District Judge Emily Tobolowsky, who had denied Gateway’s request to dismiss the claims on jurisdictional grounds.<\/p>\n

“The ecclesiastical abstention doctrine requires dismissal of real parties’ claims against relators,” Justice Mike Lee wrote for the three-judge panel.<\/p>\n

Importantly, the appeals court said it was not deciding whether statements made by Gateway about Cindy and her father, Jerry Lee Clemishire, were defamatory.<\/p>\n

“Our holding rests solely on jurisdiction; because the claims are inextricably intertwined with ecclesiastical matters, the First Amendment precludes judicial resolution of their merits,” Lee wrote.<\/p>\n

The court ordered Tobolowsky to vacate her previous ruling and grant the church’s motion to dismiss.<\/p>\n

The ruling marks a major development in a lawsuit Cindy and her father filed in June 2025 seeking more than $1 million in damages. They alleged that Morris and Gateway Church leaders publicly misrepresented the nature of the abuse Cindy suffered, including describing it as a “relationship” with a “young lady” rather than the sexual abuse of a child.<\/p>\n

The Clemishires argued those statements caused emotional and reputational harm and retraumatized their family decades after the abuse occurred.<\/p>\n

Gateway had maintained that statements made to church members about Morris and the controversy were protected internal church communications. Its attorneys argued that allowing a secular court to evaluate those statements would improperly involve the judiciary in matters protected by church autonomy.<\/p>\n

The appellate court ultimately agreed that the claims against Gateway and the three elders could not be resolved by the civil courts.<\/p>\n

In a separate opinion issued the same day, the appeals court dismissed all but one claim against Morris and other individual defendants, including his wife, Deborah Morris, and the Robert Morris Evangelistic Association. One claim against Morris remains active, meaning the litigation has not ended entirely.<\/p>\n

Gateway welcomed the ruling.<\/p>\n

“We are pleased that the Court of Appeals has dismissed the case against Gateway and the Independent Elders,” the church said in a statement. “As the Court’s opinion confirms, this case was never about Gateway.”<\/p>\n

The church noted that Morris’ abuse of Cindy occurred approximately 20 years before Gateway was founded in 2000 and said the disputed statements were made as the church sought to communicate with and “shepherd its congregation.”<\/p>\n

Gateway added that it continues to “grieve and lament” Morris’ abuse of Cindy and said it was praying for “healing and peace for Cindy and her family.”<\/p>\n

Clemishire’s legal team strongly criticized the decision.<\/p>\n

Her attorney, Jeff C. Leach, warned that the ruling could have serious consequences for survivors seeking to hold religious institutions accountable through civil courts.<\/p>\n

“No church should receive less constitutional protection because it is a church \u2014 but neither should it receive greater protection from accountability when children are sexually abused,” Leach said.<\/p>\n

He argued that religious liberty should not become a legal shield against claims involving the alleged concealment or mishandling of sexual abuse and indicated that advocates would continue fighting on behalf of survivors.<\/p>\n

The defamation dispute followed Morris’ criminal prosecution for abusing Clemishire over a four-and-a-half-year period beginning when she was 12. Morris pleaded guilty in October 2025 in Osage County, Oklahoma, and received a six-month jail sentence along with a 10-year suspended sentence. He was released from custody in March 2026.<\/p>\n

Morris founded Gateway Church in 2000 and built it into one of the nation’s most prominent megachurches before resigning in 2024 after Clemishire’s allegations became public.<\/p>\n

The appellate ruling does not determine whether Gateway’s disputed statements about the Clemishires were true or defamatory. Instead, the court concluded that the First Amendment prevents civil courts from deciding those claims because they are too closely connected to ecclesiastical matters.<\/p>\n

For Gateway Church and the three elders, that means dismissal from the case. For Morris, however, the legal battle is not entirely over, with one claim against him still moving forward.<\/p>\n","protected":false},"excerpt":{"rendered":"
