A federal judge has ruled that the Oakland Unified School District (OUSD) must allow after-school Christian clubs the same access to school facilities as secular groups, handing a major victory to religious liberty advocates.<\/p>\n

The case centers on Child Evangelism Fellowship of Northern California (CEF), the sponsor of Good News Clubs \u2014 voluntary, parent-approved programs that provide children with Bible lessons, songs, and activities after school. CEF claimed that for more than two years, OUSD repeatedly denied the ministry’s requests to use space at four elementary campuses, while permitting a wide range of secular organizations to meet.<\/p>\n

Court Rejects Discrimination Against Faith-Based Clubs<\/h3>\n

On August 15, 2025, U.S. District Judge Haywood S. Gilliam Jr. issued a preliminary injunction requiring OUSD to grant Good News Clubs the same access as groups such as the Girl Scouts, Berkeley Chess School, and Girls on the Run. The court found that OUSD had engaged in unconstitutional viewpoint discrimination in violation of CEF’s free speech rights.<\/p>\n

According to court documents, district officials cited several reasons for blocking CEF, including a lack of facility space and a reluctance to “endorse evangelism on our campus.” OUSD also refused to allow the group to apply as an official “community partner” because of its religious nature.<\/p>\n

Judge Gilliam rejected those arguments, emphasizing that Good News Clubs are not school-sponsored, meet only after school hours, and welcome all students whose parents give permission. By denying the clubs solely because of their Christian viewpoint, the district violated the First Amendment.<\/p>\n

The judge ordered both sides to file a joint case management statement by September 16 and appear for a conference on September 23, signaling that the matter is far from over but that Good News Clubs may immediately begin meeting in Oakland schools.<\/p>\n

Echoes of a Landmark Supreme Court Decision<\/h3>\n

The ruling mirrors the 2001 U.S. Supreme Court case Good News Club v. Milford Central School<\/em>, which established that public schools cannot exclude religious organizations from using facilities if other community groups are allowed. The high court determined that such exclusion amounts to unconstitutional discrimination against religious speech.<\/p>\n

“This is a great victory for Child Evangelism Fellowship, parents, and the students in Oakland public schools,” said Liberty Counsel founder and chairman Mat Staver, whose nonprofit legal organization represents CEF. “The U.S. Supreme Court has ruled that public schools cannot discriminate against Christian viewpoints regarding the use of school facilities. Child Evangelism Fellowship gives children a biblically based education that includes moral and character development. Good News Clubs should be in every public elementary school.”<\/p>\n

Liberty Counsel has indicated it will now seek a permanent injunction to ensure long-term equal access for the clubs.<\/p>\n

District Responds<\/h3>\n

In response to the court’s order, an OUSD spokesperson told Fox News Digital:<\/p>\n

“Oakland Unified School District supports the right of inclusive, non-discriminatory groups to have access to public lands such as public school property for the exercise of their First Amendment rights to assembly and free expression. As long as such groups go through the proper channels to rent District facilities, pay the going rate, take care to preserve the integrity of the grounds, and do not overstay their rental period, members of our community are welcome to use district facilities outside of school hours, and at times and in ways that do not otherwise hinder the education process for Oakland students. We welcome all groups to apply to use our facilities.”<\/p>\n

The district’s statement suggests that while it will comply with the ruling, it intends to maintain certain restrictions related to cost and facility use.<\/p>\n

A Broader Religious Freedom Battle<\/h3>\n

The case highlights ongoing tensions nationwide over religious expression in public schools. While groups such as CEF argue that excluding faith-based organizations amounts to discrimination, some school districts remain wary of appearing to endorse religious activity. Courts have consistently held, however, that providing equal access to Christian clubs does not equate to government endorsement but rather ensures fairness and free speech.<\/p>\n

For many parents and church leaders, the ruling reminds them of the importance of vigilance in protecting religious freedom. Supporters of Good News Clubs, which have existed for decades, see them as a vital way to instill biblical values and character development in children during their formative years.<\/p>\n

With this injunction, Oakland children will now have the same opportunity as their peers in other districts to participate in Good News Clubs \u2014 singing songs, hearing Bible stories, and learning about God’s love in a safe, welcoming environment.<\/p>\n
