You write that the majority&#8217;s decision is<br \/>\nflawed because it has denied the Christian Legal Society (CLS) its fundamental right<br \/>\nto religious freedom and freedom of speech. You said that CLS and other student<br \/>\ngroups at Hastings College of the Law should be able to &#8220;define their own<br \/>\nmission, select their own leaders, and determine their own membership<br \/>\ncriteria.&#8221; <br \/><\/span><\/p>\n<p class=\"MsoNormal\"><span>To<br \/>\nbe clear, this case was never about whether student groups that discriminate<br \/>\ncan exist. Of course they can. But if they want to exercise their right to<br \/>\ndiscriminate, they cannot turn around and expect to be funded by a public<br \/>\nuniversity that has a clear policy against subsidizing bias. The question<br \/>\npresented in this case wasn&#8217;t whether groups like CLS can exist, but whether<br \/>\nthey can demand public funding while still discriminating. The court&#8217;s majority<br \/>\nsaid absolutely not. <\/span><\/p>\n<p class=\"MsoNormal\"><span>As<br \/>\nJustice Stevens <a href=\"http:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1371.pdf\">wrote<\/a> in his concurring opinion, &#8220;[G]roups may exclude or<br \/>\nmistreat Jews, blacks, and women &#8211; or those who do not share their contempt for<br \/>\nJews, blacks, and women. A free society must tolerate such groups. It need not<br \/>\nsubsidize them, give them its official imprimatur, or grant them equal access<br \/>\nto law school facilities.&#8221; <a href=\"http:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1371.pdf\"><span style=\"color: windowtext\"><\/span><\/a><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt\"><span>He<br \/>\ncouldn&#8217;t be more right. <\/span><span style=\"font-size: 14pt;font-family: 'Arial','sans-serif'\"><font color=\"#000000\"><span style=\"font-size: 14pt;line-height: 115%;font-family: 'Times
