Like
\nSupreme Court Justices Alito, Scalia, Roberts and Thomas, you have
\ncharacterized this case all wrong. You write that the majority’s decision is
\nflawed because it has denied the Christian Legal Society (CLS) its fundamental right
\nto religious freedom and freedom of speech. You said that CLS and other student
\ngroups at Hastings College of the Law should be able to “define their own
\nmission, select their own leaders, and determine their own membership
\ncriteria.”
<\/span><\/p>\n

To
\nbe clear, this case was never about whether student groups that discriminate
\ncan exist. Of course they can. But if they want to exercise their right to
\ndiscriminate, they cannot turn around and expect to be funded by a public
\nuniversity that has a clear policy against subsidizing bias. The question
\npresented in this case wasn’t whether groups like CLS can exist, but whether
\nthey can demand public funding while still discriminating. The court’s majority
\nsaid absolutely not. <\/span><\/p>\n

As
\nJustice Stevens wrote<\/a> in his concurring opinion, “[G]roups may exclude or
\nmistreat Jews, blacks, and women – or those who do not share their contempt for
\nJews, blacks, and women. A free society must tolerate such groups. It need not
\nsubsidize them, give them its official imprimatur, or grant them equal access
\nto law school facilities.” <\/span><\/a><\/span><\/p>\n

He
\ncouldn’t be more right. <\/span><\/span><\/span><\/font><\/font><\/span><\/span><\/span><\/font><\/font><\/span><\/font><\/span><\/font><\/span><\/span><\/span><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/font><\/span><\/p>\n
