{"id":294,"date":"2010-06-28T14:51:00","date_gmt":"2010-06-28T14:51:00","guid":{"rendered":"http:\/\/blog.beliefnet.com\/lynnvsekulow\/2010\/06\/a-big-win-at-the-supreme-court.html"},"modified":"2010-06-28T14:51:00","modified_gmt":"2010-06-28T14:51:00","slug":"a-big-win-at-the-supreme-court","status":"publish","type":"post","link":"https:\/\/www.beliefnet.com\/columnists\/lynnvsekulow\/2010\/06\/a-big-win-at-the-supreme-court.html","title":{"rendered":"A Big Win at the Supreme Court"},"content":{"rendered":"<p class=\"MsoNormal\"><span>Today,<br \/>\nAmericans United is celebrating another victory &#8211; this time at the U.S. Supreme<br \/>\nCourt. <\/span><\/p>\n<p class=\"MsoNormal\"><span>This<br \/>\nmorning, the high court <a href=\"http:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1371.pdf\">upheld<\/a> a policy at University of California, Hastings<br \/>\nCollege of the Law that prohibits school-subsidized clubs from engaging in<br \/>\nreligious discrimination.<\/span><\/p>\n<p class=\"MsoNormal\"><span><\/span>The<br \/>\nChristian Legal Society insisted that its student chapter should be exempt from<br \/>\nthis policy and be able to discriminate against those who do not sign an<br \/>\nevangelical statement of faith or prevent students who engage in &#8220;unrepentant homosexual<br \/>\nconduct&#8221; from joining. <\/p>\n<p><span><\/span><\/p>\n<p class=\"MsoNormal\"><span>The<br \/>\nSupreme Court did not agree. <span>&nbsp;<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span>Writing<br \/>\nfor the 5-4 majority, Justice Ruth Bader Ginsburg, found that Hastings&#8217; policy<br \/>\nwas constitutional and must be followed by all student groups.&nbsp;<span><\/span>&nbsp;<\/span><\/p>\n<p><span><\/span><\/p>\n<p><!--more--><\/p>\n<p class=\"MsoNormal\"><span>&#8220;In requiring CLS&#8211;in common with all other student<br \/>\norganizations&#8211;to choose between welcoming all students and forgoing the<br \/>\nbenefits of official recognition, we hold, Hastings did not transgress<br \/>\nconstitutional limitations,&#8221; wrote Ginsburg. &#8220;CLS, it bears emphasis, seeks not<br \/>\nparity with other organizations, but a preferential exemption from Hastings&#8217;<br \/>\npolicy.&#8221;<\/span><span><\/span><\/p>\n<p class=\"MsoNormal\"><span>The<br \/>\ncourt said Hastings open access policy was reasonable and ensured that<br \/>\nleadership, educational and social opportunities were available to all<br \/>\nstudents. The court also noted that since recognized student organizations<br \/>\nreceive funds through the student-activity fees, the school&#8217;s policy ensures<br \/>\n&#8220;that no Hastings student is forced to fund a group that would reject her as a<br \/>\nmember.&#8221; <\/span><\/p>\n<p class=\"MsoNormal\"><span>Americans<br \/>\nUnited <a href=\"http:\/\/www.au.org\/media\/press-releases\/archives\/2010\/03\/amicus-brief-in-christian.pdf\">filed<\/a> a friend-of-the-court brief in this case, and is pleased with the<br \/>\ncourt&#8217;s decision. Simply stated, the Christian Legal Society sought to ignore<br \/>\nrules that every other group complied with. The organization sought<br \/>\npreferential treatment simply because it is religious. Thankfully, the court<br \/>\nsaid no to that. <\/span><\/p>\n<p class=\"MsoNormal\"><span><\/span><span>This<br \/>\nis a huge step forward for fundamental fairness and equal treatment. Religious<br \/>\ndiscrimination is wrong, and a public school should be able to take steps to<br \/>\neradicate it. Today&#8217;s court ruling makes it easier for colleges and<br \/>\nuniversities to do that.<\/span><\/p>\n<p class=\"MsoNormal\"><span>The case is&nbsp; <i>Christian Legal Society v.
