0px;padding-left: 0px;font-size: 1em;font-weight: normal\">In response to some of my &#8220;Law&#8221; posts here at Jesus Creed, a few commenters have expressed consternation over my criticism of some &#8220;conservative&#8221; Christian perspectives on the law.<span>&nbsp;&nbsp;<\/span>As I&#8217;ve tried to express in response to some of those comments, my primary concerns have to do with how &#8220;law&#8221; is understood in relation to the mission of God.<span>&nbsp;&nbsp;<\/span>As I&#8217;ve said before, in my very humble opinion, the North American Church&#8217;s participation in the &#8220;culture wars&#8221; over the past thirty years or so has been, by and large, missionally unproductive at best.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0px;margin-right: 0px;margin-bottom: 0.75em;margin-left: 0px;border-top-width: 0px;border-right-width: 0px;border-bottom-width: 0px;border-left-width: 0px;border-style: initial;border-color: initial;padding-top: 0px;padding-right: 0px;padding-bottom: 0px;padding-left: 0px;font-size: 1em;font-weight: normal\">At times, I might agree with the &#8220;conservative&#8221; perspective on what the law ideally should say &#8211; as I do, for example, concerning the law of abortion.<span>&nbsp;&nbsp;<\/span>However, even in those cases I&#8217;m often troubled by the place legal advocacy seems to occupy in &#8220;conservative&#8221; political theology, by the methods and rhetoric used to advance that theological agenda, and by the effects these dynamics have on spiritual formation in the Church.<span>&nbsp;&nbsp;<\/span>And, it&#8217;s true that, in some cases, I think the &#8220;conservatives&#8221; are advancing political priorities that fail to reflect what I understand from scripture, tradition, reason and experience to represent a faithful reflection of God&#8217;s priorities.<span>&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0px;margin-right: 0px;margin-bottom: 0.75em;margin-left: 0px;border-top-width: 0px;border-right-width: 0px;border-bottom-width: 0px;border-left-width: 0px;border-style: initial;border-color: initial;padding-top: 0px;padding-right: 0px;padding-bottom: 0px;padding-left: 0px;font-size: 1em;font-weight: normal\">In short, I think the political theology that prevails in the North American Church is insufficiently &#8220;missional.&#8221;<\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0px;margin-right: 0px;margin-bottom: 0.75em;margin-left: 0px;border-top-width: 0px;border-right-width: 0px;border-bottom-width: 0px;border-left-width: 0px;border-style: initial;border-color: initial;padding-top: 0px;padding-right: 0px;padding-bottom: 0px;padding-left: 0px;font-size: 1em;font-weight: normal\">In this post, I&#8217;d like to advance some very preliminary theses about what a &#8220;missional theology of law&#8221; should look like.<span>&nbsp;&nbsp;<\/span><b>What do you think about these Seven Theses?<span>&nbsp;&nbsp;<\/span>How does &#8220;law&#8221; relate to the &#8220;mission of God?&#8221;<span>&nbsp;&nbsp;<\/span>What should a &#8220;missional theology of law&#8221; encompass?<span>&nbsp;<\/span><\/b><\/p>\n<p><!--more--><br \/>\n<!--StartFragment--><\/p>\n<p class=\"MsoNormal\"><\/p>\n<p class=\"MsoNormal\"><span class=\"Apple-style-span\" style=\"font-style: italic\">The Seven Theses on a<br \/>\nMissional Approach to Law<\/span><\/p>\n<p class=\"MsoNormal\">(Note:<span>&nbsp;<br \/>\n<\/span>&#8220;positive law&#8221; here means simply &#8220;law enacted by human beings pursuant<br \/>\nto human governmental authority&#8221;)<\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>1.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law plays only a limited role in God&#8217;s<br \/>\neconomy of salvation.<span>&nbsp; <\/span>Neither<br \/>\nindividual human beings nor human culture can be redeemed through positive law<br \/>\nin itself.<span>&nbsp; <\/span>A missional theology of<br \/>\nlaw therefore can never mistake law for mission.<span>&nbsp; <\/span><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt\">&nbsp;<\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>2.<span>&nbsp;&nbsp; <\/span><\/span><\/span>Positive law can, however, help check the spread<br \/>\nof evil, serve as a reminder of the good, and facilitate God&#8217;s mission of<br \/>\nliberating human beings from the powers of sin and oppression.<span>&nbsp; <\/span><span>&nbsp;<\/span>A missional theology of law therefore will emphasize the<br \/>\nlaw&#8217;s liberating potential.<\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><\/p>\n<p class=\"MsoListParagraphCxSpLast\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>3.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law is provisional and temporary.<span>&nbsp; <\/span>In the eschaton, when God will be all<br \/>\nin all, the nature and function of positive law itself will be taken up by God<br \/>\nand transformed.<span>&nbsp; <\/span>A missional<br \/>\ntheology of law therefore will not have law as its ultimate <i>telos<\/i>.<\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom:0in;margin-bottom:.0001pt\">&nbsp;<\/p>\n<p class=\"MsoListParagraph\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>4.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law is contextual and incarnational.<span>&nbsp; <\/span>Although just laws always spring from<br \/>\nuniversal moral principles, positive law always represents the mediation of<br \/>\nmoral principles into a particular historical and cultural moment.<span>&nbsp; <\/span>A missional theology of law therefore<br \/>\nwill remain wary of absolutist claims about what the positive law should say in<br \/>\nany historical moment or context.<\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom:0in;margin-bottom:.0001pt\">&nbsp;<\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>5.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law is bounded by human limitations and<br \/>\nby sin.<span>&nbsp; <\/span>The natural weaknesses of<br \/>\nhuman knowledge and perception limit the human ability to craft law that will<br \/>\ncomprehensively address all wrongs.<span>&nbsp;<br \/>\n<\/span>Moreover, the pervasiveness of sin means that an ideal legal regime can<br \/>\nnever be realized prior to the eschaton.<span>&nbsp;<br \/>\n<\/span>Legal policy decisions inevitably involve choices among competing ideals<br \/>\nand suboptimal alternatives.<span>&nbsp; <\/span>A<br \/>\nmissional theology of law therefore will always be both ever reforming and<br \/>\npragmatic.<\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>6.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law derives its legitimacy primarily<br \/>\nfrom its consistency with God&#8217;s character and secondarily from the consent of<br \/>\nthe governed.<span>&nbsp; <\/span>A law that is<br \/>\nconsistent with God&#8217;s character but that is not supported by a broad public<br \/>\nconsensus ultimately will undermine the rule of law.<span>&nbsp; <\/span>A missional theology of law therefore will avoid the<br \/>\nextremes of theonomic<span>&nbsp; <\/span>\/<br \/>\nreconstructionist and libertarian approaches to law.<\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><\/p>\n<p class=\"MsoListParagraphCxSpMiddle\" style=\"margin-bottom:0in;margin-bottom:.0001pt;text-indent:-.25in\"><span><span>7.<span>&nbsp;&nbsp; &nbsp;<\/span><\/span><\/span>Positive law does not derive its legitimacy or<br \/>\nauthority from the Church or from any ecclesial body or structure.<span>&nbsp; <\/span>When the Church seeks the enactment of<br \/>\nlaws that do not enjoy a broad consensus of public support, this compromises<br \/>\nboth the rule of law and the missionary posture of the Church, even when such<br \/>\nlaws are otherwise consistent with God&#8217;s character.<span>&nbsp; <\/span><span>&nbsp;<\/span>A missional<br \/>\ntheology of law therefore will insist that legal and political advocacy embody<br \/>\nthe virtues of humility, patience, willingness to suffer, and
