I can tell you that this brief represents a clear and compelling argument: the individual mandate, which forces Americans to purchase health insurance under penalty of law, is unconstitutional. It violates the Constitution.<\/p>\n<p>I&#8217;m delighted to report that in addition to the 119 members of Congress who we will be representing on this brief, <a href=\"http:\/\/aclj.org\/obamacare\/brief-supreme-court-reject-obama-unconstitutional-law\" target=\"_blank\">we have now heard from nearly 160,000 Americans<\/a>\u00a0who will stand with us &#8211; who will be part of our brief at the high court.<\/p>\n<p>A majority of Americans has consistently opposed ObamaCare, with only 29% of Americans supporting it, according to a recent <a href=\"http:\/\/ap-gfkpoll.com\/featured\/president-obama-and-the-economy\" target=\"_blank\">AP poll<\/a>. But what caught my attention today was an <a href=\"http:\/\/www.usatoday.com\/news\/opinion\/forum\/story\/2012-01-18\/doctors-obama-health-reform-ppaca\/52650852\/1\" target=\"_blank\">opinion editorial<\/a> in USA Today\u00a0written by Dr. Marc Siegel, a respected physician, who also serves as a <a href=\"http:\/\/www.foxnews.com\/archive\/author\/dr-marc-siegel\/index.html\" target=\"_blank\">medical contributor on FOX News<\/a>.<\/p>\n<p>What Dr. Siegel pointed out is alarming. He argues there are several reasons why a growing number of physicians oppose the health care law. Many doctors, he says, just don&#8217;t think the law makes economic sense. And, Dr. Siegel says the measure is likely to lead to what he calls a &#8220;diminished system&#8221; for patients.<\/p>\n<p>That translates into longer waiting times for patients. And, according to a <a href=\"http:\/\/www.deloitte.com\/assets\/Dcom-UnitedStates\/Local%20Assets\/Documents\/us_lshc_PhysicianPerspectives_121211.pdf\" target=\"_blank\">recent survey by the Deloitte Center for Health Solutions<\/a> research group, nearly 3 out of every 4 doctors surveyed believe ObamaCare won&#8217;t reduce health care costs. What&#8217;s more, <a href=\"http:\/\/www.usatoday.com\/news\/opinion\/forum\/story\/2012-01-18\/doctors-obama-health-reform-ppaca\/52650852\/1\" target=\"_blank\">a majority of doctors<\/a>, who took part in another survey, don&#8217;t believe the American Medical Association (AMA), which endorsed ObamaCare in 2009, represents their views. The primary reason: the AMA&#8217;s support of the measure.<\/p>\n<p>One more thing. If you think the new health care law will attract the best and the brightest to the medical profession, think again. According to this Deloitte survey, 69% of the physicians are &#8220;pessimistic about the future of medicine&#8221; because of the law.<a href=\"http:\/\/blog.beliefnet.com\/faithandjustice\/files\/2011\/08\/1212685981.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-thumbnail wp-image-972\" src=\"https:\/\/wp-media.beliefnet.com\/sites\/240\/2011\/08\/1212685981-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p>Of course, none of these facts and findings has dampened the Obama Administration&#8217;s optimism that this flawed law will clear the Supreme Court challenges ahead.<\/p>\n<p>In what was described as <a href=\"http:\/\/thehill.com\/blogs\/healthwatch\/politics-elections\/205083-sebelius-rallies-healthcare-base-for-2012-fight\" target=\"_blank\">a rally for ObamaCare advocates<\/a>,\u00a0Health and Human Services Secretary Kathleen Sebelius warned that the law&#8217;s opponents are &#8220;definitely going to take their best shot.&#8221; As Secretary Sebelius put it: &#8220;Over the next few months we&#8217;ll see the biggest barrage of attacks and misinformation about the law we&#8217;ve ever seen, and that&#8217;s hard to do &#8211; increase the misinformation.&#8221;<\/p>\n<p>Sadly, most of the misinformation about ObamaCare is coming from the Obama Administration itself.<\/p>\n<p>The facts are the facts. ObamaCare represents <a href=\"http:\/\/aclj.org\/obamacare\/how-obamacare-uses-taxpayer-money-pay-abortions\" target=\"_blank\">the largest expansion of abortion funding using taxpayer funds<\/a> since Roe v. Wade. And, forcing Americans to purchase a particular good or service is a fundamental assault on our liberty &#8211; an extraordinary power grab &#8211; giving Congress nearly unlimited power over our lives.<\/p>\n<p>Most Americans get it. A growing number of physicians get it.<\/p>\n<p>And, soon, the issue will be before the Supreme Court.
