{"id":1683,"date":"2017-06-09T10:35:57","date_gmt":"2017-06-09T14:35:57","guid":{"rendered":"http:\/\/www.beliefnet.com\/columnists\/attheintersectionoffaithandculture\/?p=1683"},"modified":"2017-06-09T10:35:57","modified_gmt":"2017-06-09T14:35:57","slug":"comeys-testimony-no-obstruction-justice","status":"publish","type":"post","link":"https:\/\/www.beliefnet.com\/columnists\/attheintersectionoffaithandculture\/2017\/06\/comeys-testimony-no-obstruction-justice.html","title":{"rendered":"Comey&#8217;s Testimony: No Obstruction of Justice"},"content":{"rendered":"<p>After former FBI Director James Comey decisively undermined the Big Lie, the Vast Left-Wing Conspiracy that President Trump and\/or his associates \u201ccolluded\u201d with \u201cthe Russians,\u201d his enemies in the Government-Deep State-Media Regime began to switch tactics.<\/p>\n<p>There was no collusion, or even any necessarily inappropriate contacts between Trump and the enigmatic \u201cRussians.\u201d However, the anti-Trump forces declared, there <em>was <\/em>an attempt on the part of the President to \u201cobstruct justice.\u201d<\/p>\n<p>As everyone now knows, Lieutenant General Michael Flynn, who was Trump\u2019s National Security Adviser, was fired by the President not long after acquiring his position.\u00a0 Flynn, as it happened, had misled Vice President Mike Pence after failing to disclose that he had discussed with Russian ambassador Sergey Kislyak the sanctions that Barack Obama slapped on Russia immediately before leaving office.\u00a0 The President, as well as many others, maintains that in having these discussions, Flynn acted unobjectionably, much less criminally.<\/p>\n<p>Still, because he misled Pence, Trump asked for his resignation.<\/p>\n<p>In a private conversation regarding Flynn, Trump expressed his \u201chope\u201d to Comey that the latter could \u201csee your way clear to letting this go, to letting Flynn go.\u201d\u00a0 \u201cHe is a good guy,\u201d the President added.\u00a0 \u201cI hope you can let this go.\u201d<\/p>\n<p>Comey <em>agreed<\/em> with Trump\u2019s assessment of Flynn\u2019s character. \u201cI agree he is a good guy.\u201d<\/p>\n<p>There are two considerations to bear in mind here.<\/p>\n<p>First, if Comey has reason to believe that General Flynn is indeed \u201ca good guy,\u201d then doesn\u2019t this suggest that he felt as strongly as his boss that this good guy is not a criminal?\u00a0 Is it morally possible for anyone, to say nothing of the head of one of our nation\u2019s leading law enforcement agencies, to consistently commend a man for his character while suspecting that he is a criminal?\u00a0 I have yet to hear anyone raise this question.<\/p>\n<p>Second, as has been said by even Democrat and Hillary Clinton supporter Alan Dershowitz, famed Harvard University Professor Emeritus of Law, Trump, being Comey\u2019s boss, does indeed <a href=\"http:\/\/www.foxnews.com\/politics\/2017\/06\/08\/comey-testimony-trump-has-constitutional-authority-to-stop-investigation-any-person-dershowitz-says.html\">have the authority<\/a> to tell his subordinates who they will and won\u2019t prosecute: The heads of the intelligence agencies serve at the behest of the President. This being said, <em>this <\/em>president did <em>not <\/em>direct <em>this <\/em>FBI Director to prosecute or not anyone.<\/p>\n<p>Republican Senator James Risch made sure that Comey established this.\u00a0 Risch quoted Comey\u2019s own words back to him when questioning him about \u201callegations that the President of the United States obstructed justice.\u201d Alluding to the page and paragraph numbers of those parts of Comey\u2019s memo in which the latter quotes Trump, Risch reminded him that Comey placed in quotation marks the President\u2019s use of the words \u201cI hope\u201d during their conversation over Flynn.\u00a0 The dialogue between Risch and Comey was as follows:<\/p>\n<p>Risch: \u201cNow, those are his exact words; is that correct?\u201d<\/p>\n<p>Comey: \u201cCorrect.\u201d<\/p>\n<p>Risch: \u201cAnd you wrote them here and you put them in quotes.\u201d<\/p>\n<p>Comey: \u201cCorrect.\u201d<\/p>\n<p>Risch: \u201cThank you for that. He [Trump] <em>did not direct you to let it go<\/em>\u201d (emphasis added).<\/p>\n<p>Comey: \u201cNot in his words, <em>no<\/em>\u201d (emphasis added).<\/p>\n<p>Risch: \u201cHe <em>did not order you to let it go<\/em>\u201d (emphasis added).<\/p>\n<p>Comey: \u201cAgain, those words <em>are not an order<\/em>\u201d (emphasis added).<\/p>\n<p>Risch: \u201cNo. He said, \u2018I hope.\u2019 Now, like me, you probably did hundreds of cases, maybe thousands of cases, charging people with criminal offenses.\u00a0 And of course you have knowledge of the thousands of cases out there where people have been charged.\u00a0 Do you know of any case where a person has been charged for obstruction of justice or for that matter any other criminal offense where they said or thought they hoped for an outcome?<\/p>\n<p>Comey: \u201cI don\u2019t know well enough to answer.\u00a0 And the reason I keep saying his words is, I took it as a direction.\u201d<\/p>\n<p>Risch: \u201cRight.\u201d<\/p>\n<p>Comey continued, explaining that he <em>felt <\/em>that the President was attempting to derail the investigation into Flynn.\u00a0 Risch didn\u2019t relent:<\/p>\n<p>\u201cYou may have taken it as a direction, but that\u2019s not what he said.\u201d<\/p>\n<p>Comey: \u201cCorrect.\u201d<\/p>\n<p>Risch: \u201cHe said, \u2018I hope.\u2019\u201d<\/p>\n<p>Comey: \u201cThose are exact words, correct.\u201d<\/p>\n<p>Risch: \u201cYou don\u2019t know of anyone that\u2019s been charged for hoping something?\u201d<\/p>\n<p>Comey was forced to capitulate: \u201cI don\u2019t, as I sit here.\u201d<\/p>\n<p>Of course, no one has ever been prosecuted for expressing a hope.<\/p>\n<p>Nor is Flynn a \u201c<a href=\"http:\/\/www.nbcnews.com\/news\/us-news\/flynn-manafort-are-key-figures-russia-probe-mueller-will-lead-n761256\">key figure<\/a>\u201d in \u201cthe\u201d Russia probe, as Fake News outlets would have us think. \u00a0Even a professional Trump-hater like MSNBC\u2019s Chris Mathews had to concede that both the Russian \u201ccollusion\u201d conspiracy (that he has busily peddled) as well as the Regime\u2019s line on Flynn \u201ccame apart\u201d during Comey\u2019s testimony.<\/p>\n<p>As it turns out, <a href=\"http:\/\/www.washingtonexaminer.com\/chris-matthews-trump-russia-collusion-theory-came-apart-with-comey-testimony\/article\/2625372\">Mathews said<\/a>, \u201cFlynn wasn\u2019t central to the Russian investigation.\u201d<\/p>\n<p>There was no Trump\/Russian \u201ccollusion.\u201d\u00a0 The President was never the subject, or even a part of, a criminal investigation.\u00a0 Trump never sought to obstruct justice, and Flynn is anything but a \u201ckey figure\u201d in some \u201cRussian probe.\u201d This is what came out of James Comey\u2019s testimony.<\/p>\n<p>There were, however, other damning things to take away from it. Yet it is Comey, former Attorney General Loretta Lynch, and, by implication, former President Barack Obama who were damned.<\/p>\n<p>Comey\u2014the head of the most powerful law agency in the country\u2014when asked why, potentially in violation of the law, he refused to report what he supposedly suspected was an attempt on Trump\u2019s part to obstruct justice, replied that he lacked the strength and courage to do so!<\/p>\n<p>He further reinforced the impression of his weakness of character when he expressly said that Obama\u2019s AG, Loretta Lynch, directed him to mislead Congress and the nation into thinking, <em>counterfactually<\/em>, that Hillary Clinton was not under a criminal investigation.\u00a0 It was Clinton, Comey admitted, <em>not <\/em>Trump, who was indeed the subject, <em>the target,<\/em> of a <em>criminal investigation. <\/em><\/p>\n<p>It was Lynch, <em>not <\/em>Trump, who opened herself to the charge that she sought to \u201cdirect,\u201d or \u201cmisdirect,\u201d an FBI investigation.<\/p>\n<p>It was Obama, Lynch, and Comey, not Trump, who politicized law enforcement for the sake of protecting, not Flynn or anyone else on Team Trump, but Clinton.<\/p>\n<p>Trump\u2019s enemies can continue trying to push the Vast Left-wing Conspiracy of Russian Collusion. They are the only people who care about it.\u00a0 But since this Big Lie came at a price, those who spread it must be made to pay their share of the cost.<\/p>\n<p>The Trump administration is now, reportedly, looking into <a href=\"http:\/\/www.nbcnews.com\/politics\/white-house\/trump-lawyer-file-leak-complaint-after-comey-testimony-source-says-n770231\">pursuing Comey<\/a> for being <a href=\"http:\/\/www.nydailynews.com\/news\/politics\/comey-admits-leaking-trump-memo-special-prosecutor-article-1.3231652\">a leaker<\/a>.\u00a0 This is a start.
