{"id":497,"date":"2010-02-18T12:44:27","date_gmt":"2010-02-18T12:44:27","guid":{"rendered":"http:\/\/blog.beliefnet.com\/apagansblog\/2010\/02\/patrick-mccollum-california-and-the-constitution.html"},"modified":"2010-02-18T12:44:27","modified_gmt":"2010-02-18T12:44:27","slug":"patrick-mccollum-california-and-the-constitution","status":"publish","type":"post","link":"https:\/\/www.beliefnet.com\/columnists\/apagansblog\/2010\/02\/patrick-mccollum-california-and-the-constitution.html","title":{"rendered":"Patrick McCollum, California and the Constitution"},"content":{"rendered":"<p><!--StartFragment--><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">The spirit of the Burning Times is<br \/>\nalive and well in California.<span>&nbsp; <\/span>So I<br \/>\ndiscovered this past weekend at Pantheacon.<span style=\"font-family: Times\"><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\">For<br \/>\nyears Patrick McCollum has worked to provide Pagan ministerial services for<br \/>\nincarcerated Pagans, as is provided by Christian and other monotheistic<br \/>\nreligions. <\/span>For his efforts McCollum has been told<span>&nbsp; <\/span>by a prison supervisor that according<br \/>\nto the Bible, which he took out and read from, he was commanded to kill<br \/>\nMcCollum because &#8220;Thou shalt not suffer a witch to live.&#8221;<span>&nbsp; <\/span>Fortunately his fear of the law was<br \/>\ngreater than his bigotry and ignorance of accurate translations.<span>&nbsp; <\/span>But it gets worse.<span style=\"font-family: Times\"><\/span><\/p>\n<p><!--EndFragment--><\/p>\n<p><!--more--><br \/>\n<!--StartFragment--><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span>McCollum is a member of the American Correctional Chaplain<br \/>\nAssociation, and since 1997 has been a statewide Wiccan chaplain for the<br \/>\nCalifornia Department of Correction.<span>&nbsp;<br \/>\n<\/span>He has also served as a Wiccan chaplain in the Federal Bureau of<br \/>\nPrisons, and helped mentor chaplains from many faith traditions across the<br \/>\ncountry. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\">I<br \/>\nmyself worked with Pagan prisoners a little bit when I taught at Whitman<br \/>\nCollege in Walla Walla,<\/span> Washington, where a major penitentiary is<br \/>\nlocated. Many inmates deeply appreciate the attention they receive while being<br \/>\nassisted in keeping or strengthening their connection with our Gods.<span>&nbsp; <\/span>Fortunately Washington is a civilized<br \/>\nstate on these issues compared to California.<span>&nbsp; <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">A staff member of the California<br \/>\nDept. of Corrections put McCollum in a confined space, attacked the Wiccan<br \/>\nfaith while telling McCollum that he, the officer, had been &#8220;bathed in the<br \/>\nblood of Jesus.&#8221;<span>&nbsp; <\/span>Later, in the<br \/>\nspirit of Jesus and truth fundamentalist style, he claimed in front of other<br \/>\ncorrectional officers to have seen videos of McCollum killing children and<br \/>\ndrinking blood.<span>&nbsp; <\/span>These officers<br \/>\nthen told inmates of these allegations, leaving McCollum&#8217;s life in danger.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">A Protestant Chaplain serving<br \/>\nmaximum security inmates told them it was their responsibility under God to &#8220;do<br \/>\nwhatever was necessary to make Wiccan services did not continue and McCollum<br \/>\ncould not move forward.&#8221;<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">As McCollum told me, dozens of<br \/>\nhigh level Department of Corrections officials, wardens, correctional staff,<br \/>\nand many but by no means all correctional chaplains intentionally promoted<br \/>\ndiscrimination against Wiccans.<span>&nbsp;<br \/>\n<\/span>There are good people in the State Dept of Corrections, but McCollum<br \/>\ntold me they have been rendered powerless by Evangelical bigots and are<br \/>\nsometimes even penalized for objecting to discrimination.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">Don&#8217;t we have a constitution that<br \/>\nguarantees freedom of religion?<span>&nbsp;<br \/>\n<\/span>Yes we do, but these people twist its meaning and, if pressed, say, as<br \/>\none did to McCollum: &#8220;The reason Pagans are not getting their rights is because<br \/>\nit&#8217;s God&#8217;s Will.&#8221;<span>&nbsp; <\/span>When she was<br \/>\nconfronted with her responsibilities under California law and the US<br \/>\nConstitution, that as a state administrator she was responsible for following<br \/>\nthe law, she replied &#8220;I do not answr to the law or the constitution.<span>&nbsp; <\/span>I only answer to the Lord.&#8221;<\/p>\n<p class=\"MsoNormal\"><b>Enter the Courts<\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">This kind of illegal theocratic<br \/>\nbigotry and worse led to a court case that has been making its way through the<br \/>\ncourts for 5 years.<span>&nbsp; <\/span>Until recently<br \/>\nthe Dept. of Corrections argued both in court and publicly that they had<span>&nbsp; <\/span>been conscientiously seeking to<br \/>\ndetermine the religious needs of their inmates, and accommodate them.<span>&nbsp; <\/span>They argued they have a &#8220;Fair and<br \/>\nneutral policy&#8221; concerning prison chaplains and accommodating minority<br \/>\nfaiths.<span>&nbsp; <\/span>This includes determining<br \/>\nthe numbers of inmates with specific religious needs.<span>&nbsp; <\/span>Of course had they done this there would be no court case.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">Now, in both testimony and<br \/>\ndeposition, they have admitted they have not applied any of the criteria that<br \/>\nthey claimed for five years to be following.<span>&nbsp; <\/span>As McCollum told me with regard to this claim, &#8220;They<br \/>\nadmitted that everything they testified to under oath was false.&#8221;<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">Instead California is now arguing<br \/>\nthey do not have to take the wishes and needs of Pagan prisoners into account<br \/>\nbecause they follow a &#8220;5 Faiths System.&#8221;<span>&nbsp;<br \/>\n<\/span>Five faiths count: Protestant and Catholic Christianity, Judaism, Islam,<br \/>\nand Native Americans.<span>&nbsp; <\/span>The rest do<br \/>\nnot count as constitutionally protected religions! <\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">This bigoted argument has been<br \/>\npromoted by<a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1097670\"> such as &#8220;Justice&#8221; Anton Scalia<\/a>, &nbsp;who argue that the Founders did not know of other religions and so could not<br \/>\nhave meant them when trying to safeguard religious liberty.<span>&nbsp; <\/span>This is an excellent example of<br \/>\nconservative bigotry masquerading as learning since <a href=\"http:\/\/www.nobeliefs.com\/jefferson.htm\">Jefferson wrote<\/a><span style=\"font-family: Times\"> in his <i>Notes on Virginia<\/i><\/span><span style=\"font-family: Times\"><span>&nbsp; <\/span>&#8220;&#8230; it<br \/>\ndoes me no injury for my neighbor to say there are twenty gods or no God. It<br \/>\nneither picks my pocket nor breaks my leg.&#8221;&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\">That<br \/>\nScalia and every conservative who agrees with him is intellectually dishonest<br \/>\ncan be easily demonstrated.<span>&nbsp; <\/span>The<br \/>\nFounders did not know of rifled barrels.<span>&nbsp;<br \/>\n<\/span>Should the right to keep and bear arms be confined to muzzle loaders?<span>&nbsp; <\/span>No conservative has ever argued such.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\">California is backed up in its<br \/>\nbigotry by America&#8217;s home grown Taliban, the &#8220;Wallbuilders, Inc&#8221; &nbsp;<a href=\"http:\/\/www.wallbuilders.com\/\">a<br \/>\ndominionist organization of bigots<\/a> who filed an amicus brief supporting<br \/>\nCalifornia.<span>&nbsp; <\/span>So far as I know they<br \/>\nare the only amicus brief submitted on California&#8217;s behalf, which says a<br \/>\nlot.<span>&nbsp; <\/span>That so-called liberal Jerry<br \/>\nBrown is California&#8217;s Attorney General says volumes as to what the lust for<br \/>\noffice will do to a man who once was worth something as a politician.<\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\">As<br \/>\nMcCollum told me. &#8220;One of the primary and central issues of this case has<br \/>\nalways been discrimination against the Pagan inmates.&#8221;The case will be heard by<br \/>\nthe 9<sup>th<\/sup> Circuit Court and the stakes are high.<span>&nbsp; <\/span>If California and Fundamentalist<br \/>\nbigotry stands, a precedent will be established to undermine religious toleration<br \/>\nfor every other faith in the state.<span>&nbsp;<br \/>\n<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\"><b>What<br \/>\nCan We Do?<\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent: 9pt\"><span style=\"font-family: Times\"><b>Write<br \/>\nthe Governor of California<\/b><\/span><span style=\"font-family: Times\">.<span>&nbsp; <\/span>This is a federal case, so you do NOT<br \/>\nhave to be a California resident to make your views known.<span>&nbsp; <\/span>If California prevails, similar efforts<br \/>\nwill be made in other states.<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">Governor Arnold<br \/>\nSchwarzenegger\u2028<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">State Capitol Building<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">\u2028Sacramento, CA 95814\u2028<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">Phone: 916-445-2841\u2028<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">Fax: 916-558-3160 <\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\"><b>For the same reason write<br \/>\nCalifornia&#8217;s Attorney General.<\/b><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: Times\">Edmund G.
